Terms & Conditions

1. Scope

These Terms & Conditions apply to photography services provided by Dano Odermatt Fotografie unless otherwise agreed in writing.

Individual agreements, quotations and contracts take precedence over these Terms & Conditions.

2. Booking and Contract

A booking becomes binding once the client accepts a quotation, confirms the booking in writing or signs the corresponding agreement.

The scope of the photography service, duration, location, deliverables, price and any additional services are defined in the individual quotation or agreement.

3. Prices and Payment

All prices are stated in Swiss francs (CHF) unless otherwise agreed.

Payment terms are specified in the relevant quotation or invoice.

Additional services, additional shooting time, travel expenses, accommodation or other costs not included in the original quotation may be charged separately where agreed or reasonably necessary for the assignment.

4. Travel and Additional Expenses

Travel costs, parking fees, accommodation and other necessary expenses may be charged in addition to the photography fee unless they are expressly included in the agreed price.

Any substantial additional costs will be discussed with the client in advance whenever reasonably possible.

5. Cancellation and Rescheduling

If the client cancels or postpones a confirmed booking, Dano Odermatt Fotografie may charge reasonable cancellation costs depending on the timing of the cancellation and work already performed.

Any specific cancellation conditions stated in an individual quotation or contract take precedence.

If a booking needs to be postponed due to circumstances beyond either party's reasonable control, both parties will make reasonable efforts to find an alternative date.

6. Photographer's Inability to Perform

If Dano Odermatt Fotografie is unable to perform the agreed services due to illness, accident or another serious unforeseen circumstance, reasonable efforts will be made to inform the client as soon as possible and, where appropriate, assist in finding an alternative photographer.

Any amounts already paid for services that cannot be provided will be refunded, unless otherwise agreed.

Further liability is excluded to the extent permitted by law.

7. Image Selection and Editing

The photographer determines the artistic and technical selection of the images delivered.

Images that are duplicates, test shots, technically unsuitable or otherwise not part of the final selection are not normally delivered.

The final images are edited according to the photographer's visual style and professional judgement.

RAW files and unedited files are not included unless expressly agreed in writing.

8. Delivery

The expected delivery timeframe is defined in the quotation, booking agreement or individual communication with the client.

Delivery times are estimates unless expressly agreed as binding.

Images are generally delivered digitally through an online gallery, download link or another agreed method.

9. Copyright

Copyright and all intellectual property rights in the photographs remain with Dano Odermatt Fotografie unless expressly transferred in writing.

The client receives only the usage rights expressly agreed for the relevant assignment.

10. Usage Rights – Private Clients

For private photography assignments, including portraits, couples, families and weddings, the client receives a non-exclusive right to use the delivered images for personal and private purposes.

This generally includes:

  • personal printing

  • sharing with friends and family

  • private social media accounts

  • personal websites or similar non-commercial use

Commercial use, resale, licensing to third parties or use for advertising is not included unless separately agreed.

11. Usage Rights – Business and Commercial Clients

For business, branding, corporate and event assignments, the client receives a non-exclusive commercial licence to use the delivered images for its own communication and marketing purposes unless otherwise agreed.

This may include:

  • company websites

  • social media

  • newsletters

  • press and public relations

  • presentations

  • internal communication

  • brochures and printed materials

  • organic and paid digital marketing

Unless expressly agreed otherwise, the licence does not include:

  • resale of the photographs

  • sublicensing to unrelated third parties

  • transfer of ownership or copyright

  • use by third-party brands or organisations not involved in the assignment

Extended usage rights, campaigns, large-scale advertising, third-party licensing or exclusive usage may require a separate agreement and additional fee.

12. Events and Third Parties

For event photography, the contracting client is responsible for informing attendees, employees, guests or other relevant persons about photography where required.

The client is also responsible for obtaining any permissions or consent that fall within the client's organisational responsibility.

Dano Odermatt Fotografie will act with reasonable consideration when photographing identifiable individuals.

The publication of photographs remains subject to applicable personality and data protection rights.

13. Portfolio and Self-Promotion

Dano Odermatt Fotografie may use photographs for its own portfolio, website, social media, exhibitions, competitions, publications and self-promotion where this has been agreed with the client or is otherwise legally permitted.

For private assignments, particularly weddings, couples and family photography, portfolio publication may be subject to individual agreement or consent.

Where a client requires confidentiality or prohibits portfolio use, this should be agreed before the assignment.

14. Editing by the Client

The delivered photographs may not be substantially altered, manipulated or modified in a way that misrepresents the photographer's work unless otherwise agreed.

Normal resizing, cropping or formatting required for websites and social media is permitted.

15. Credits

A photographer credit is appreciated when images are published but is not required unless expressly agreed.

Where a credit is agreed, the preferred form is:

or the relevant social media account specified at the time of the assignment.

16. Image Storage

Dano Odermatt Fotografie may store completed projects for a reasonable period after delivery.

Clients are responsible for downloading and securely backing up their delivered images.

Permanent storage or archiving is not guaranteed unless expressly agreed.

17. Liability

Dano Odermatt Fotografie performs all assignments with reasonable professional care.

Liability for indirect damages, consequential losses, loss of profit or damages resulting from circumstances outside the photographer's reasonable control is excluded to the extent permitted by law.

If technical failure, data loss or another unforeseen issue results in partial or complete loss of photographs, liability is limited to the amount paid for the affected photography service to the extent permitted by law.

18. Client Cooperation

The client is responsible for providing relevant information necessary to carry out the assignment, including schedules, locations, access requirements, important persons, restrictions and other organisational details.

Dano Odermatt Fotografie is not responsible for missed photographs resulting from inaccurate information, delays, restrictions or circumstances outside the photographer's reasonable control.

19. Data Protection

Personal data is processed in accordance with the Privacy Policy available on this website and applicable data protection law.

20. Applicable Law and Jurisdiction

These Terms & Conditions are governed by Swiss law.

The place of jurisdiction is determined in accordance with applicable Swiss law.

21. Changes to these Terms

Dano Odermatt Fotografie may update these Terms & Conditions from time to time.

The version applicable to an individual assignment is the version accepted or incorporated into the relevant contract at the time of booking.
