Terms & Conditions
1. General
These Terms & Conditions apply to all photography services provided by Dano Odermatt Fotografie.
By booking a photography session or event, the client agrees to these Terms & Conditions.
2. Booking
A booking becomes confirmed once both parties have agreed on the service and, where applicable, any requested booking fee has been received.
The agreed date is reserved exclusively for the client.
3. Payment
The final invoice must be paid within the agreed payment period stated on the invoice.
Late payments may be subject to reminder fees where permitted by law.
4. Cancellations & Rescheduling
If the client needs to reschedule a session, every effort will be made to find a suitable alternative date.
In the event of cancellation, any booking fee already paid may be non-refundable unless otherwise agreed.
For outdoor sessions, weather-related changes can be discussed individually.
5. Delivery
Edited photographs are delivered digitally via an online gallery.
Delivery times may vary depending on the type and size of the project. Every effort is made to deliver all images within the communicated timeframe.
6. Editing Style
The client acknowledges that all photographs are edited in the artistic style of Dano Odermatt Photography.
Requests for substantial changes to the editing style after delivery cannot be guaranteed.
7. RAW Files
RAW files and other unedited image files remain the property of Dano Odermatt Fotografie and are not included in the delivered product unless otherwise agreed in writing.
8. Copyright
All photographs remain the intellectual property and copyright of Dano Odermatt Fotografie unless otherwise agreed in writing.
Clients receive a licence to use the delivered images for the purposes agreed upon at the time of booking.
Commercial use beyond the agreed scope requires prior written permission.
9. Portfolio & Marketing
Selected photographs may be used for portfolio purposes, social media, exhibitions, competitions, publications, or promotional material unless otherwise agreed with the client.
Where required, consent will always be obtained before publication.
10. Client Responsibilities
The client is responsible for providing accurate information regarding locations, schedules, permits (where applicable), and any relevant details that may affect the photography session.
11. Force Majeure
Dano Odermatt Fotografie cannot be held responsible for circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, accidents, illness, government restrictions, or technical failures.
In such cases, every reasonable effort will be made to reschedule or find an appropriate solution.
12. Drone Photography
Drone photography may be offered where legally permitted and where weather, safety conditions, and local regulations allow.
Drone images cannot be guaranteed for every booking.
13. Limitation of Liability
While every reasonable effort is made to provide the highest quality service, liability is limited to the amount paid by the client for the booked service.
14. Governing Law
These Terms & Conditions are governed by the laws of Switzerland.
Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the competent Swiss courts.
